How do you feel about the monetary “gifts” that Malacañang gave out to government officials?
Since time immemorial, the crime of bribery has always plagued human existence specially the integrity of the government. In legal parlance, terms such as plunder and violation of Republic Act 3019 otherwise known as The Anti-graft and Corrupt Practices Act have evolved and gained significance in the court arena. Beautiful landmark and jurisprudential cases had emerged from Justices of immense knowledge and wisdom. And those guilty of such are expertly doing these things in a manner as to avoid as much as possible charges and convictions against them. When you do a crime and you have a good lawyer, everything else will be dismissed. It is how the lawyers defend the case and interpret a million times the law that makes their case a winning one. These officials that these people accused are posted with great lawyers to defend them. So what ordinary citizens think does not matter. Opinions are merely a display of an array of insignificant words for only the Supreme Court has the last say on the matter. Bribery is hard to convict because the giver and the receiver must both be charged otherwise, there will be no crime to constitute bribery. Plunder is difficult to be proven beyond reasonable doubt because it demands so much evidence for it entails a penalty of reclusion perpertua or life imprisonment. Closest would be the charge of violation of Anti-graft and Corrupt Practices Act (RA3019). But who will they charge? The President? No! No! No! That cannot be because the President is immune from suit. You cannot sue the President. Impeachment complaint? That’s next to impossibility because an impeachment complaint can only be filed once a year and it needs an impossible voting count from The House and The Senate. So for those who complain, nag around, and exercise their freedom of speech on such political hotspot issue, my suggestion? Study first the laws affecting these criminal charges and possible prosecution so you would not be made a laughing stock. Better keep the opinion to yourself. I am not Pro-administration nor Anti-administration, I merely stand inside the halls of law and beside the majestic throne of the Supreme Court.
